of supervisor's husband to new county position County officials claim deputy became a target after whistle-blowing incident; Attorney General's Office said to be investigating La Paz County Sheriffs
A lawyer representing the Arizona Conference of Police and Sheriffs and the La Paz County Deputies Association, has requested an investigation into La Paz County Supervisor Holly Irwin, accusing her of joining the board in creating a chief park ranger position that was filled by her husband immediately after being approved.
The letter, addressed to La Paz County Attorney Sam Vederman and written by Martin A. Binh of Binh & McDaniel of Phoenix, intimated that the supervisor is "guilty of a class 2 misdemeanor," by violating the states law concerning nepotism.
"We understand that Holly Irwin voted to create the position but then abstained from voting on the actual appointment," Binh wrote in his letter. "This abstention does not insulate her from criminal culpability. Under the nepotism statute a public official may not, '...work for, suggest or arrange such an appointment.'"
Binh claimed that La Paz County never posted the position, accepted applications, conducted testing or a search for candidates.
He noted that La Paz County already has a chief park ranger and that there was no need for a second one.
A perk of the new position, Binh said, was that Irwin would be provided a county vehicle and county gasoline to transport him the 90 miles to and from his job in Parker.
Binh suggested that the position was created as a result of an incident experienced by Larry Irwin, a La Paz County Sheriff's deputy who was unable to get immediate backup while on a fight call; something he said "every deputy in the SO has experienced."
"Unfortunately, in her effort to make the world safe for her husband and her family, Holly Irwin neglects the families of each and every law enforcement officer in the Sheriff's Office," Binh wrote. "Instead of responsibly addressing the problem of a lack of deputies on duty, Holly Irwin simply makes the problem worse. She takes her own husband out of the equation and thus makes the work place more dangerous for all the other deputies."
Binh then went on to make numerous public record requests from the county including all of Holly and Larry Irwin's e-mails from June 1, 2009 through Oct. 1, 2009.
Binh gave the county until Jan. 11 to deliver the records and the letter was forwarded to Arizona Attorney General Terry Goddard.
Joe Escorza, President of the La Paz County Deputies Association, said that the Association's legal counsel advised him last week that the La Paz County Attorney conflicted out and has referred the matter to the Maricopa County Attorney's Office for investigation.
La Paz County Manager Dan Field confirmed that the county attorney had passed the letter on to the Maricopa County Attorney's Office, but said it was merely to have an outside third party look at it - and for political reasons.
Escorza said he didn't believe that either the La Paz County Sheriff's Office nor the Parks Department were aware of Larry Irwin's appointment to the position or even that a position was being created.
Field said that the position of Chief Park Ranger had been requested in the past by the current park ranger, due to continuing incidents of vandalism and theft occurring at county parks.
Escorza said that an investigation into park calls, which Larry Irwin would be responsible for, showed only 30 over the course of the last year, most in the summer months.
Second-in-command Undersheriff Rick Paterson said that the Sheriff's Office was taken by surprise by the move as there have never before been lateral transfers between the two agencies.
The county is overseen by an elected board of supervisors while the Sheriff's Office is overseen by an elected Sheriff, both who answer to voters.
Field defended the lateral transfer as being legal and said that while the sheriff was an elected official, it was the county board of supervisors that oversaw his budget and that were responsible for lawsuits and other actions taken against the Sheriff's Office.
The county also oversees personnel issues, including the filing of grievances by sheriff personnel.
"In this particular case the lateral transfer was caused by allegations of whistle blowing and current issues of criminal misconduct under investigation by the Arizona Attorney General's Office," Field said.
"I can't go into details because its an ongoing investigation but they are looking at several allegations. The office over there has committed many of the seven deadly sins."
Paterson said that the loss of Irwin, a canine officer, would hurt the department, which had invested a substantial amount of money and time in training him and the dog.
Holly Irwin said the charges of her engineering a position for her husband were false and that she had recused herself from voting for the creation of the position as well as the transference of her husband into the job.
"The state of Arizona does not recognize that union," Holly Irwin said. "Its a private union - people pay into and it is not recognized by the state whatsoever. This is coming up because we have the Sheriff's Office under investigation with the AG's office for criminal activity."
Well-placed county sources confirmed that the Attorney General's Office had been contacted by the county to investigate charges of embezzlement that involved at least three sheriff officials.
The Attorney General's Office does not confirm investigations.
Field reiterated that Larry Irwin was transferred because he was a "whistle blower" and suggested that his investigation of law enforcement brass could lead to repercussions and possible danger to him.
He said that as the county manager he had a responsibility to make sure Larry Irwin was protected and that attorney Binh had a history of Bar complaints and that his letter would more than likely generate a lawsuit from the Irwins.
"The allegations are inaccuracies and I would go so far as to say bold face lies," Field said.

i want to know how a guy can sell a mobile home thats been condemed by la paz county and that has mold all through the home,no power, no air conditioning, and is still apart and can never be lived in the home has to be torn down. but list home on someone elses web site. and this man was told of all the mold, and that the home was condemned but says, that was just one person saying that, he was warned,but won't listen to reason.

Wake Up- Let's talk about the "good ole boy" system. First, a Policeman assaults two kids. One at the local barber shop and the other while he was at school. Now I know you are someone who will try to shroud the truth. So let me say before you go off on some silly tangent. I heard about this from Johnny at the barber shop and confirmed it with your Sheriff. Your wonderful Sheriff ("good ole boy") told me he didn't do much because the school superintendent didn't want anything done. That’s just great same stuff we have seen for years. I voted for Don, he told me he would make people accountable, suuuure. I am sure he will if he doesn’t like you. Sounds like your one of the decision makers causing all of the problems. Keep up the good work soon you will run off all the good Policemen and only you misfit ("good ole boy's") will be left. I wish we had the Don I knew back. Don, leave that wicked place and get back to your roots. Only trouble can come from these bitter castaways. Larry, don't worry about this crap. I talk to a bunch of people everyday and believe me they know the truth.

Wow- I agree with you, Larry Irwin needs to watch his back. These guys are very hostile. You know when ever your dealing with internal problems, like they obviously have. You have to be very careful. These guys want to protect the lawless freedom they have had for what seems to be a very very long time. Larry keep up the fight do not let them break you. This blog has shown how really bad you had it.

Sometimes it''s nice to have a little truth to go along with a meal of backbiting, ignorance, and revisionism. The truth is that in spite of the allegation contained in this article and promulgated by the Sheriff''s Association and the attorney representing it, Supervisor Irwin did not participate in the dicussion or vote regarding the creation of the position of Chief Park Ranger. Neither does the County currently have a Chief Park Ranger but rather a Parks Director. The County has multiple parks with many assets, structures, and visitors, and crimes occuring against county property have never been properly investigated in the past. Did the sheriff''s office locate the thief of $10,000 in copper cable stolen from the Centennial Community Center during construction? Did they locate the person responsible for stealing the Bouse transponder? Both of these were county assets purchased with federal funds. Heck! The sheriff''s department can''t even locate their own radios
purchased with homeland security dollars. Every resident of the outlying areas of the County knows full well that response times for incidents are ridiculously long, and investigations (when launched) result in nothing. The issue is not the number of deputies but the location of the equitable assignment of deputies. Why are response times far lower and staffing numbers so much higher for the Parker Strip than for the 10,000 square miles of the remainder of La Paz County.

Wake up people!
Have you ever thought that Holly was having lunch with a senator, probably Senator Aguirre, to use her political influence to start an investigation into allegations that were handled by the prior Sheriff's administration? Any and all of these allegations are from the prior Sheriff's term. If you people think that the Irwin's are good people, well good for you but they are the good ole boy system that we are trying to get rid of! Irwin was just pissed that he could not take calls from his house like he was used to doing. The Board is no better than the previous Board. And whoever knows Escorza and knows he is not an "angle" learn to spell. I'm sure you're no Angel yourself. If Irwin was working in a hostile work environment, where and when was the complaint filed and who investigated it? That is the protocol of any allegation. No, instead Dan Field, who has run for everything in this County and lost, takes it upon himself to say that the County needs to create a position to avoid litigation. He is supposed to be a County Administrator, conveniently after Holly Irwin was elected and after 6 years of looking for a county administrator, not an attorney. He talks like he is Irwin's attorney. No what is happening here is that the Board is trying to cover their rears for their ignorance in thinking that the people of this County are just going to sit around and let them do what they want just because they think they are "somebody"! Shame on all of you, especially you Holly and John Drum. Sandy, well she is clueless and just goes along with it.
There has never been any proper investigations done on Irwin. His K-9 is brought up and is also defended by Biro as saying that he approved burying a dead dog. Just took his word for it since he is his buddy. Told Lt Gilbert to investigate it and of course closed it out with just Irwin’s word as to what happened. Now tell me, why would Irwin purchase this dog himself? Bunch of B.S. And Salome Frogs you’re so ignorant! If you want to know where Victoria is, she is still in the area. Not that it matters that her parents were abusive! Another allegation by Irwin. It’s funny how obsessed he is with Escorza!
Hey “M” why don’t you ask Commander Davis why he encouraged the Sheriff to seek outside counsel to get the Board to approve Whittier for a position that Irwin stated that he was discouraged from applying for? Why did Irwin seek out Escorza and offer to testify about the position that the outgoing Regime had promised her?
Well, if Escorza has the kind of “friends” that consider him a friend but don’t think he should be a cop, well then who needs enemies?
Words of the day, just another plot to lay blame on something that was investigated supposedly by La Paz Counties finest including Irwin and all unfounded!

Mr. Field: About your claim, "the office over there has committed many of the Seven Deadly Sins". Are you referring to the "Biblical List" or one of the several revised lists that have been promulgated over the centuries, such as Dante's? These lists are so different that only one sin is common to the two lists, that being Sloth. Now, if it's the more modern one, well that's the one that would really be of interest to most folks I think. That's the one with all the "good stuff". Let's see how "that office" stacks up against them vs. your accusation. 1. Lust! Well, if you stretch it a bit, I guess it could refer to someone getting "screwed", but I think that's a Jack Daniels kind of interpretation. 2.Gluttonry. I can see it now. The Sherrifs sue to get their Deputy back AND a sack of fries! 3. Greed. Next! 4.Sloth. Universally known as the least serious of the sins, despite "cleanliness being next to Godliness". When most people associate the word "dirty" with a Law Officer they're not usually thinking in terms of how often he/she bathes. 5. Wrath. True, there are better choices of people to pee-off than someone with a badge and a gun, but it doesn't mean 'revenge'. The actual definition is "Wrath (Latin, ira), also known as anger or "rage", may be described as inordinate and uncontrolled feelings of hatred and anger. These feelings can manifest as vehement denial of the truth, both to others and in the form of self-denial, impatience with the procedure of law, and the desire to seek revenge outside of the workings of the justice system (such as engaging in vigilantism) and generally wishing to do evil or harm to others." Well, Mr. Field, don't feel bad. You can always fall back on the old "it's all in how you look at it" ploy. After all, compared to zero, one or two is "many". I have to give you credit though. Right or wrong it takes bones to call out a Para-Military Orginazation with the wide spread reputation for, shall we say, leaving no 'problem' unresolved. Myself, I'd rather put salt in Superman's Wheaties than risk an old fashioned 'dirt-nap'.

Some people are happy working there and I'm sure some are not. They should at least be thankful they have a job. Not all of us will see eye to eye on this matter some say the board was right to creat a new position and fill it they way they did. Others don't see it as being fair. Lets just all get over it and move on.

Oh please let me guess you think Paterson runs the department? What ever to each their own I guess. But thats not how everyone sees things. I haven't come across any changes made by Don I don't like. It's just sad how many people don't give change a chance. We gave Hal a chance and he screwed things up enough.
